The rules of using Trac products and services.

1. Acceptance of Terms

By downloading or using Trac (the “App”), provided by Trac Software Solutions Inc. (“Trac”, “we”, “us”, or “our”), you agree to these Terms and Conditions (“Terms”). If you do not agree, you must discontinue use of the App. Using the App indicates that you accept these Terms and agree to abide by them.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Trac App for your personal, non-commercial use. You may not distribute, sell, or reverse engineer the App or any part of it except as permitted by law. All rights not expressly granted to you are reserved by Trac.

3. Permitted and Prohibited Uses

When using the App, you agree to use it only for its intended purpose of viewing shuttle bus route and schedule information. You agree not to:

  • Use the App in any unlawful, harmful, or abusive manner, or in violation of any applicable laws or regulations.
  • Interfere with or disrupt the App’s operation or servers/network connected to the App.
  • Attempt to circumvent any security or access controls of the App.
  • Use any automated system (e.g. robots or scraping) to access the App in a manner that sends more requests than a human can reasonably produce.

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, if we believe you have violated these Terms or are misusing the service.

4. Transit Information and Service Availability

Trac provides live shuttle bus locations, estimated arrival times (ETAs), and related transit information for your convenience. While we strive for accuracy, all transit information is provided on an “as is” and “as available” basis, without warranties of any kind. Route maps, schedules, ETAs, and bus locations may be subject to change, delays, or inaccuracies beyond our control. Use your own judgment when planning travel, and understand that actual bus arrival times or availability may differ from what the App displays.

Trac is currently intended for use in supported regions of Ontario, Canada. The App may not function or provide relevant data in other locations. We do not guarantee that the App or any of its content is available or appropriate outside of our service area.

5. Third-Party Services and Links

Third-Party Services: Trac integrates with third-party services to function. Notably, we use Firebase (a service by Google) for our backend infrastructure and Mapbox for map and location data in the App. Your use of those services within Trac is subject to their own terms and policies. We are not responsible for services provided by Firebase, Mapbox, or other third parties, and your interactions with those services are governed by the respective third-party’s terms of service and privacy policy.

External Links: The App may present links or integrations to external websites or services (for example, multimodal transport links or optional donation pages). These links are provided for convenience, and Trac does not endorse or assume responsibility for the content, accuracy, or practices of any third-party websites. If you choose to follow links to third-party sites (such as a payment processor for donations), you do so at your own risk. 6. Intellectual Property

All content, features, and functionality in the App (including software, text, graphics, logos, and trademarks) are owned by Trac Software Solutions Inc. or its licensors and are protected by intellectual property laws. You are not granted any rights to use Trac’s name, logos, or trademarks, or any content from the App, except as necessary for your personal use of the App in compliance with these Terms. You must not remove or obscure any copyright, trademark, or other proprietary rights notices displayed in the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle your personal data (if any). We do not require you to create an account or provide personal identifying information to use Trac, and we do not collect personal data from you in the ordinary use of the App. By using the App, you acknowledge that you have read and agree to the Privacy Policy, which is incorporated herein by reference.

8. Disclaimers of Warranties

Trac is provided “as is” and “as available” without any warranty or condition, express or implied. We specifically disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. While we will attempt to correct bugs and inaccuracies as we find them, we make no guarantee that the App’s data (such as bus locations or ETAs) will always be accurate, up-to-date, or reliable. You assume full responsibility for your use of the App and any decisions made based on information provided by the App.

9. Limitation of Liability

To the maximum extent permitted by law, Trac Software Solutions Inc. and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the App. This includes, without limitation, any damages for lost time, missed transportation, personal injury, or any other losses or inconveniences resulting from reliance on the App’s information. Trac will not be responsible for any damage to your mobile device or loss of data that results from use of the App. In all cases, Trac’s total liability for any claims arising from or related to the App will be limited to the amount (if any) you paid to use the App (the App is provided free of charge, so ordinarily this amount is zero). Some jurisdictions do not allow certain warranty disclaimers or liability exclusions, so some of the above limitations may not fully apply to you. In such cases, Trac’s liability will be limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Trac Software Solutions Inc., its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your misuse of the App, your violation of these Terms, or your violation of any law or rights of a third party. This means that if a third party makes a claim against Trac because of your actions (for example, your misuse of the App or infringement of someone’s rights), you will be responsible for any costs or damages we incur as a result.

11. Changes and Updates to These Terms

We may modify or update these Terms from time to time. If we make material changes, we will update the “Last Updated” date at the top of the Terms and (if feasible) notify you through the App or via other communications. Continued use of the App after any changes to the Terms constitutes your acceptance of the revised Terms. It is your responsibility to review the Terms periodically for updates. If you do not agree with any changes, you should stop using the App.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, as well as the federal laws of Canada applicable therein, without regard to conflict of law principles. By using the App, you agree that any dispute arising from or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You consent to personal jurisdiction and venue in the courts located in Ontario for the purpose of litigating such disputes.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
